Terms of Use for Bakerate
These Terms of Use also serve as Bakerate’s General Terms and Conditions (“Allgemeine Geschäftsbedingungen” / AGB) for German and EU consumers.
These Terms of Use (“Terms”) govern your use of Bakerate (the “App”), provided by David Perez, trading as miraiapps.de, Ettalstr. 9, 81377 München, Germany (“we,” “our,” or “us” — full business details in our Impressum). By downloading or using Bakerate, you agree to these Terms.
1. The App
Bakerate is a bread-recipe calculator that scales recipes by weight, loaf count, or pan preset, computes baker’s-percentage and starter/hydration math, and lets you save recipes and log your bakes locally on your device. The App requires a Bakerate Pro purchase to use — there is no free tier and no free trial. Bakerate Pro is available as an auto-renewing monthly or yearly subscription, or as a one-time lifetime purchase.
2. Subscriptions and Purchases (Bakerate Pro)
- Bakerate Pro is required to use Bakerate. Current pricing: €2.99/month, €19.99/year, or a one-time €39.99 lifetime purchase — see the in-app purchase screen for the definitive, currency-localized price before you buy, as this may change over time.
- All purchases are billed through your Apple ID account and processed by Apple, which acts as the merchant of record for the transaction. Payment is charged at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to.
- You can manage or cancel your subscription any time in your device’s App Store account settings, or via Settings → Manage Subscription inside Bakerate.
- No portion of an unused subscription period is refundable except as required by law or Apple’s own refund policies. Refund requests go through Apple at reportaproblem.apple.com — we do not process refunds directly, since we never receive your payment details.
- Prices, billing periods, and what Bakerate Pro unlocks are shown on the in-app purchase screen before you buy and may change for future purchasers; existing subscribers will be notified of material price changes as required by law before any new price applies to them.
2a. Right of Withdrawal (EU/EEA consumers)
If you are a consumer located in the EU/EEA, you generally have a 14-day right of withdrawal from a distance contract. For digital content not supplied on a physical medium — which includes Bakerate Pro — this right ends early once performance has begun, provided you have given express consent to immediate access and acknowledged that you thereby lose your right of withdrawal (Art. 16(m) Consumer Rights Directive 2011/83/EU; § 356 Abs. 5 BGB). Apple presents this consent as part of the App Store purchase flow. Because Bakerate Pro unlocks the App immediately on purchase, your right of withdrawal ends at that point once you’ve given this consent.
3. Your Content
Recipes, bake logs, and other content you create in Bakerate are stored only on your device. You are responsible for your own device backups; we cannot recover this data if it’s lost, since we never receive a copy of it (see our Privacy Policy).
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law
- Use the App for any unlawful purpose
- Interfere with or disrupt the App’s operation or attempt to circumvent subscription enforcement
5. Intellectual Property
Bakerate, its design, and its underlying code are owned by David Perez (miraiapps.de) and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
6. Disclaimer of Warranties
Bakerate is provided “as is” without warranties of any kind. While we’ve done our best to make the baking math correct, we do not guarantee the accuracy of any recipe, scaling calculation, or bake time/temperature suggestion — always use your own judgment, an oven thermometer, and food-safety common sense when baking.
7. Limitation of Liability
To the maximum extent permitted by law, David Perez (miraiapps.de) is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to a ruined batch of bread.
8. Termination
You may stop using the App at any time by deleting it. We may suspend or discontinue any part of the App at our discretion, though we’ll try to give notice of any change that removes features you’ve paid for.
9. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of protections granted by mandatory consumer-protection provisions of the law of your country of habitual residence, if that is within the EU/EEA and stricter than German law.
10. Changes to These Terms
We may update these Terms as the App evolves. Continued use of the App after a change means you accept the updated Terms. Material changes will be noted in the app’s “What’s New” release notes.
11. Apple’s Standard EULA
If you’d rather use Apple’s Standard End User License Agreement instead of custom Terms, App Store Connect provides that as a default — these custom Terms are only needed if you want subscription-specific language beyond Apple’s default, which most subscription apps do (see Guideline 3.1.2).
